Report Rental Terms & Conditions

Welcome to Report Rentals ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website and services (the "Platform"), which enables users to report, access, and review rental information related to tenants, landlords, and residential properties across Canada. By using our Platform, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

1. Eligibility

To access or use Report Rentals, you must:

  • Be at least 18 years of age
  • Reside in Canada or use the Platform in accordance with Canadian laws
  • Have legal capacity to enter into binding agreements

If you use the Platform on behalf of an organization, you represent that you are authorized to bind that entity.

2. Account Creation and Responsibilities

To use most features, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials confidential
  • Promptly update any information that becomes outdated
  • Accept full responsibility for all activity conducted under your account

We may suspend or terminate your account if we suspect fraudulent, abusive, or unlawful use.

3. Platform Functionality

Report Rentals is designed to:

  • Allow users to submit reports about rental payment behaviour, property conditions, and landlord/tenant conduct
  • Provide access to rental histories or behavior profiles (to the extent permitted by law)
  • Offer optional paid services (e.g., verification badges, premium analytics)

We do not act as a credit reporting agency or legal advisor. Content on the Platform is user-submitted and not verified unless explicitly stated.

4. User-Generated Content

You are solely responsible for all content you submit, including rental reviews, dispute comments, property descriptions, payment histories, or supporting documentation ("User Content").

You represent and warrant that:

  • Your content is accurate, lawful, and non-defamatory
  • You have all necessary rights to publish it
  • It does not infringe any third-party rights, including privacy, copyright, or contractual obligations
  • It complies with all applicable laws, including provincial tenancy legislation and PIPEDA

You grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content in connection with the Platform.

We reserve the right (but not the obligation) to remove or moderate any User Content for legal, ethical, or platform integrity reasons.

5. Prohibited Conduct

You agree not to use the Platform to:

  • Post false, misleading, or malicious content
  • Publish private, sensitive, or identifying personal information without lawful basis or consent
  • Harass, threaten, or intimidate other users
  • Defame landlords, tenants, or other parties
  • Circumvent, disable, or interfere with Platform security or features
  • Access or scrape data using automated methods without written consent

We may involve legal authorities or pursue civil remedies if violations involve fraud, harassment, or unlawful activity.

6. Canadian Privacy and Data Protection

We are committed to protecting your privacy in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

By using the Platform, you:

  • Consent to our collection, use, and disclosure of personal information as described in our Privacy Policy
  • Confirm that you are authorized to provide any third-party personal information included in your submissions
  • Acknowledge that some submitted data may become visible to other users, subject to access controls and consent

We take reasonable steps to safeguard personal data, but we are not responsible for user misuse of publicly accessible content.

7. Accuracy and Limitations of Reports

The Platform is a tool for collecting and sharing information, not a verified authority on any individual's rental history. You acknowledge:

  • We do not independently verify all user submissions
  • Information may be outdated, incomplete, or inaccurate
  • Reports should not be solely relied upon for tenancy or leasing decisions

Landlords and tenants are encouraged to use the Platform as one input among many in their screening or decision-making process.

8. Paid Features and Subscription Services

We may offer optional paid services, including but not limited to:

  • Identity or ownership verification
  • Enhanced report visibility
  • Subscription-based analytics dashboards

All fees will be disclosed before purchase. By completing a transaction, you agree to:

  • Provide valid, up-to-date billing information
  • Pay applicable charges, including sales taxes (e.g., GST/HST depending on province)
  • Understand that payments are non-refundable, except as required by law or our refund policy

We reserve the right to modify pricing or discontinue services with notice.

9. Intellectual Property

The Platform and its contents, excluding User Content, are the intellectual property of Report Rentals or its licensors. This includes:

  • Website design, branding, and layout
  • Software code and infrastructure
  • Reports generated using proprietary tools

You may not reproduce, modify, distribute, or use our IP without written permission.

10. Platform Availability

We aim to provide reliable service but do not guarantee:

  • That the Platform will be uninterrupted or error-free
  • That data loss will not occur
  • That all services will be available in every region of Canada

We may update, suspend, or discontinue the Platform at our discretion.

11. Disclaimers

To the fullest extent permitted by law, Report Rentals:

  • Provides the Platform "as-is" without warranties of any kind
  • Does not guarantee the accuracy or legality of any user-submitted content
  • Is not responsible for tenant-landlord disputes arising from the use of the Platform
  • Does not act as an intermediary or arbitrator in any disputes

We do not offer legal advice, and users should consult appropriate professionals for guidance on tenancy laws or dispute resolution.

12. Limitation of Liability

To the maximum extent allowed by applicable law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages
  • This includes damages from reliance on user-generated reports, loss of rent, reputation harm, or data breaches
  • Our total liability will not exceed $100 CAD or the amount paid to us in the last 12 months, whichever is greater

Some provinces do not allow certain limitations, so these may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Report Rentals and its affiliates from any claims, damages, or liabilities arising from:

  • Your use of the Platform
  • Your User Content
  • Your violation of these Terms or applicable laws

14. Dispute Resolution and Governing Law

These Terms shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

You agree that any legal action must be brought in the courts of Toronto, Ontario, and you waive any objections to that venue.

15. Termination

We reserve the right to suspend or terminate your access for any breach of these Terms. Upon termination:

  • Your license to use the Platform ends immediately
  • We may delete your account and content (unless retention is legally required)
  • Certain provisions (e.g., indemnity, IP rights, disclaimers) will survive termination

16. Changes to Terms

We may update these Terms from time to time. Changes will be effective:

  • Upon posting to our website, or
  • After reasonable notice (e.g., via email or user dashboard)

Continued use of the Platform after such changes constitutes acceptance.
